On December 17, 2009, the three members of an Arbitral Tribunal constituted under the auspices of the Arbitration Institute of the Stockholm Chamber of Commerce, issued an Award unanimously dismissing the jurisdictional objections raised by the Respondent to the arbitration proceedings commenced by Mercuria Energy Group Ltd under the Energy Charter Treaty dated December 17, 1994(ECT).
The same decision rejected Poland's request for the suspension of the arbitral proceedings, so that these can now continue on the merits of the case.
